Terms of Service
These Terms and Conditions supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted. Use of Beautiful Idea web services constitutes acceptance of these Terms and Conditions.

Website Development/Project Fees
An initial retainer deposit is required before work on the web project begins. Following, billing for work accrued will be every 2 weeks, and the balance is to be paid on completion and acceptance by the client and prior to making the website accessible to the public.

Monthly Minimum
By signing up for our 3-hr monthly retainer, you save on website maintenance fees. If you are not spending more than 3 hours a month on your website, then you are not keeping your website actively engaged. It is our experience that this amount of time is barely a minimum of monthly maintenance.

The 3-hr monthly service retainer service is a committment for the term of 1 year. The committment locks you into a low monthly rate for the initial 3 hours of website maintenance. After the first 3 hours, normal rates apply. The 3 hours will be applied towards your domain, web hosting, email accounts, analytics, marketing, and website maintenance, as determined by Beautiful Idea, LLC, unless we receive specific client work request for the minimum monthly 3 hours. Monthly fees will be charged automatically through a secure PayPal credit card service located on this page.

Unused time will not roll over to the next month.

If payment is by credit card or PayPal, the subscriber authorizes Beautiful Idea, LLC to charge the credit card listed on the subscription form for Beautiful Idea, LLC past-due balances that are overdue for 20 days or more, in order to bring the account to current status. Beautiful Idea, LLC may charge the amount due to the provided card after 20 days of invoice delivery.

Opting out of the 3-hr monthly service
You may opt out of the monthly retainer. In this case, Beautiful Idea will not track, retain, archive or notify you about your ongoing website, hosting or domain maintenance, passwords, protocols, images, renewal, credit card expirations or overcharge issues, updates, or expiration of accounts. If you opt out of the 3-hr monthly retainer, Beautiful Idea will provide services for you on a per job basis, and normal rates will apply. You will be responsible for supplying any account protocols or images that are needed for your website, online presence, Google, social media, web hosting and domain. You will be subject to "normal" rates and a retainer fee may be required for all requests and work done. A minimum 1-hour charge will be billed for each request at normal rates. You will be billed for any time required in finding necessary passwords in order to access your accounts, images, or any other protocols necessary to your project request. A retainer fee may be required before work begins.

For web service orders of $2150 or more, Beautiful Idea will hold your account protocols for 6 months. Your account protocol tracking will expire after 6 months, unless you sign up for the 3-hr minimum plan.

Accounts are in default if payment is not received within 20 days after date of invoice.

Payment

Unless you have a current, pending retainer balance, payment is due immediately after date of invoice. All payments must be in US dollars and withdrawable from a US bank. The subscriber is responsible for providing up-to-date payment information. Beautiful Idea, LLC will not be held responsible should the subscriber's payment information becomes out-of-date.

If a subscriber's check is returned by the bank as unredeemable, the subscriber will be deemed to be in default, and will be liable for a "returned check" charge of $25. Beautiful Idea may charge the amount due for any past-due balances, in order to bring the account to current status

Interruption of Service
Accounts unpaid 20 days after date of invoice may have their service interrupted. Such interruption does not relieve the subscriber from the obligation to pay the monthly charge, account balance, or any other charges accrued. Accounts in default are subject to a late payment charge of $25 and an interest charge of the maximum allowable rate for the subscriber's state will be charged. If the subscriber defaults, the subscriber agrees to pay Beautiful Idea, LLCs its reasonable expenses, including attorney and collection agency fees, incurred in enforcing its rights under these Terms and Conditions. All files, information and mail under the account will be preserved for 20 days from the date the payment is due. If the payment is not received after 20 days, all files, information and mail under the account will be deleted. If the subscriber wishes to use the service again, the subscriber must re-apply as a new subscriber, and setup charges will apply.

Termination For Breach of Nonpayment.
Beautiful Idea shall have the right to terminate web services, web hosting, and domain administration services without limitation, if customer does not remedy payment within 20 days of termination notice.

Protection of Content
Customer acknowledges and agrees that Client is solely responsible for ensuring the integrity of its Content. Although Beautiful Idea Design may provide data backup upon request, Client is advised that Beautiful Idea in no way is responsible for any damages resulting from the loss of Client’s Content, regardless of the reason for such loss. Client is solely responsible for backing up/archiving Client’s Content.

Indemnification
Customer shall indemnify and hold harmless Beautiful Idea, LLC from and against any and all claims, demands, actions, causes of action, suits, proceedings, losses, damages, costs, and expenses, including reasonable attorneys fees, arising from or relating to Customer’s provision, or an end user’s use, of Customer’s Content, or any act, error, or omission of Customer in connection therewith, including but not limited to matters relating to incorrect, incomplete, or misleading information; libel; invasion of privacy; infringement of a copyright, trade name, trademark, service mark, or other intellectual property or other right; or violation of any applicable law.

Alteration of Code / Contents
Beautiful Idea is a professional web design firm employing current code protocols. Once a site is completed, it is highly recommended that Beautiful Idea continue to maintain the site in order to prevent unauthorized code modification that could cause malfunction of the site. If the "Customer" chooses to modify site contents and code, or employ another firm to modify site contents or code, Customer shall indemnify and hold harmless Beautiful Idea, LLC from and against any and all claims, demands, actions, causes of action, suits, proceedings, losses, damages costs, and expense. If customer modifies the website resulting in a need for code, image, or content repair, a reinstatement fee in addition to billable hours will be required in order to restore the site to it's previous condition.
